This paper questions the narrative of a linear move from jus soli to jus sanguinis as the basis of Indian citizenship by arguing that there have been contending elements of jus sanguinis present from the founding moment of the republic and that the politics of religious identity remain central to the framing of citizenship. The paper interprets the jurisprudence on citizenship as a legacy of the Partition and, to the extent that attributions of affect have played a role in determining the veracity of citizenship claims, the valuation of documents of identification and claims to property, as indicative also of the contingent quality of that event.
